Terms and Conditions
Rental agreement for the use of Restore Haus properties
Property Details
Here you will feel as if you are in the forest, yet minutes from West Asheville. You are welcome to explore the 9 acres of land where the property is nestled. We kindly ask you to respect the privacy of the other property, especially if we have other guests staying.
The land is delimited by pink survey markings; anything beyond that is not our property, so we ask you to stay within the markings.
There are two rentals on the land approx 50 yards from each other. The houses were site built to maintain privacy including window placement.
There is a locked basement below the property, not accessible during the stay.
There may be wildlife on the property, and there are black bears in this area of North Carolina, so we ask that you don’t leave any food outside. Encounters are rare on our property.
Accessibility: There are 6 steps to access the loft area (bed/bathroom) at Haus 43.
We do have a Security Camera on the exterior part of the home, facing out, that records audio and video 24/7 for the safety of the property and guests.
Our driveway is gravel. If it is snowing or icy you may need 4 wheel drive, otherwise 2 wheel drive is fine.
We have abundant wildflowers on our property. You are more than welcome to pick them.
Our digital guidebook, which will be sent to you upon booking, will have much greater details on our property, how to best use our amenities and ideas and suggestions of places to visit in the area.
House Rules
No smoking or Vaping inside the property. If you smoke outside, please make sure to clean butts and ashes along with fully putting out any lighted material as this area can be prone to forest fires in the dry season.
Illegal drugs are not allowed on the property and will result in removal from the property, and may involve the authorities if necessary.
Pet Policy: We allow up to 2 dogs of 50lb each, for $100 in total per stay. Dogs over 50lb are not allowed. We reserve the right to decline the accommodation for certain dog breeds.
Occupancy: Max occupancy is 2 people at Haus 43 and 4 people at Haus 50. You will need to get written approval from the owners, a signed waiver and verify all approved guests through Enso Connect for any additional guests or service providers brought onsite. Verification includes a copy of their photo ID and matching photo. This includes day visitors and service providers (example-massage). For the booking parties’ child or children this is not required under 18 years of age as long as included on the reservation.
Parties are strictly prohibited including large gatherings or events, and there is a $1,000 fine, in addition to the expenses incurred for additional cleaning or items broken/missing. You’ll also be required to vacate the premises immediately. Glitter, confetti, fireworks, and piñatas are prohibited both inside and outside the unit. Fireworks of any kind are strictly prohibited on the property. Failure to comply will result in a $1,000 fine.
No commercial photography allowed without written consent by owners.
No swimming or wading in the pond or spring
Follow all posted hot tub rules. Never set or use the hot tub above 104 degrees. Use is at the guests own risk.
Must be at least 25 years old to book
Quiet hours are 10 pm-10 am
Property Maintenance
We handle maintenance issues as quickly as we can. In many cases, we have a short window of time since we are notified of an issue and your arrival time. If we need to access the premises to take care of any issues, we will notify you as soon as we can.
Lawn Mowing, pest control, hot tub cleaning, trash services or other scheduled routine services may happen during your stay. Lawn mowing is bi-monthly and will come onto the premises. Hot tub service is every Tuesday.
Damage Deposit
Please report any property damage during your stay during or no later than checkout as this greatly helps us work on the issue quickly.
All guests are charged a non-refundable $25.00 limited damage fee upon booking.
You are responsible for any damage to the property that may occur during your stay that would result in additional cleaning needs, broken items or failure to follow our terms and conditions.
Cancellation Policy
The cancellation policy is available to you before confirming the reservation. Once the reservation has been confirmed, it is assumed that you acknowledge the cancellation policy. We recommend you purchase travel insurance to cover any losses due to cancellations. Change of dates follows the cancellation policy.
Payment in full is required at the time of booking to reserve your dates and complete your booking.
100% of the payment is refundable 30 calendar days prior to first scheduled date of stay. 50% refund within 14 days of stay. 0% refund 13 days or less from the start of your stay.
Should the owners need to cancel a reservation due to issues outside of their control where the property is not accessible or not functioning a full refund will be provided.
CHECK-IN BEGINS AT 4:00 P.M. (EST) & CHECK-OUT IS BY 10:00 A.M. (EST). With our approval a late check out or early check in may be allowed with an additional cost.
Photo verification and acknowledgement of our terms and conditions is required through your Enzo connect boarding pass process after your booking is confirmed and before you receive access to Restore Haus. The name on the credit card and photo ID must match the person booking and staying with us.
All guests staying or visiting the property must be disclosed and approved prior to your stay.
Failing to comply with House rules: violations are grounds for immediate termination of the reservation without a refund.
By booking with us you acknowledge that Restore Haus, its’ owners and property management BNB Way LLC are not responsible for any accidents, injuries or loss of personal belongings during your stay.
This Guest Waiver and Release of Liability (“Agreement”) is made by and between the undersigned Guest (“Guest”) and the bnb way, LLC, its members, managers, employees, representatives, co-hosts, affiliated service providers, and the owner(s) Dennis and Melinda Gabor of the property described above (“Released Parties”).
By signing this Agreement, Guest acknowledges and agrees to the following:
Assumption of Risk
Guest and all members of the booking party understand and accept that use of the property, including but not limited to its stairs, decks, outdoor areas, natural surroundings, appliances, amenities, and any recreational equipment, may involve inherent risks, including the risk of personal injury, illness, disability, death, or property damage. Guest voluntarily assumes all risks related to such use.
Release and Waiver
To the fullest extent permitted by law, Guest, on behalf of themselves and all individuals in their booking party (including minors and invitees), hereby releases, waives, and agrees to hold harmless the bnb way, LLC, the property owner(s), and all affiliated parties from any and all claims, liabilities, actions, damages, costs, or expenses arising from bodily injury, death, property damage, or loss sustained by Guest or their party during the stay, whether caused by negligence or otherwise.
Indemnification
Guest agrees to indemnify and hold harmless the bnb way, LLC, and the property owner(s) from and against any and all claims, demands, causes of action, damages, costs, and attorney’s fees arising from or related to Guest’s stay at the property.
Acknowledgment of Responsibility
Guest acknowledges that they are responsible for the safety and behavior of all individuals in their booking party and any visitors they allow onto the property during their stay. All visitors must be disclosed and approved prior to accessing the property including any third party services (ex. massage)
Jurisdiction and Enforceability
This Agreement shall be governed by the laws of the State of North Carolina. If any portion of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
By signing below, Guest acknowledges that they have read, understand, and voluntarily agree to the terms and conditions of this waiver and release of liability.

Restore Haus(the “Company”) is committed to maintaining robust privacy protections for its users. Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Service.
For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at Restorestay.com or through our mobile application.
“Service” refers to the Company’s services accessed via the Site, in which users can book short term rental stays. The terms “we,” “us,” and “our” refer to the Company. “You” refers to you, as a user of our Site or our Service. By accessing our Site or our Service, you accept our Privacy Policy and you consent to our collection, storage, use and disclosure of your Personal Information as described in this Privacy Policy.
Information We Collect
We collect “Non-Personal Information” and “Personal Information.” Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks.
Personal Information includes your email, name, address, which you submit to us through the registration process at the Site.
Information collected via Technology
in an effort to improve the quality of the Service, we track information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to the Service, the time and date of access, and other information that does not personally identify you. We track this information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive. Sending a cookie to a user’s browser enables us to collect Non-Personal information about that user and keep a record of the user’s preferences when utilizing our services, both on an individual and aggregate basis. Log Files
Restore Haus follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this as part of hosting services' analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users' movement on the website, and gathering demographic information.
Cookies and Web Beacons
Like any other website, Restore Haus uses ‘cookies'. These cookies are used to store information including visitors' preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users' experience by customizing our web page content based on visitors' browser type and/or other information.
Children’s Privacy
The Site and the Service are not directed to anyone under the age of 13. The Site does not knowingly collect or solicit information from anyone under the age of 13, or allow anyone under the age of 13 to sign up for the Service. In the event that we learn that we have gathered personal information from anyone under the age of 13 without the consent of a parent or guardian, we will delete that information as soon as possible. How We Use and Share Information
Personal Information:
Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for the Company, such as the servers for our email communications who are provided access to user’s email address for purposes of sending emails from us. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy.
In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers.
We may share Personal Information with outside parties if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce applicable Terms of Service, including investigation of potential violations; address fraud, security or technical concerns; or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law.
Non-Personal Information:
In general, we use Non-Personal Information to help us improve the Service and customize the user experience. We also aggregate Non-Personal Information in order to track trends and analyze use patterns on the Site. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion.
In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy. If our information practices change at any time in the future, we will post the policy changes to the Site so that you may opt out of the new information practices. We suggest that you check the Site periodically if you are concerned about how your information is used.
HOW WE PROTECT INFORMATION
We implement security measures designed to protect your information from unauthorized access. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.
YOUR RIGHTS REGARDING THE USE OF YOUR PERSONAL INFORMATION
You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail.
LINKS TO OTHER WEBSITES
As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Site and the Service. Therefore, this Privacy Policy does not apply to your use of a third party website accessed by selecting a link on our Site or via our Service. To the extent that you access or use the Service through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them.
CHANGES TO OUR PRIVACY POLICY
The Company reserves the right to change this policy and our Terms of Service at any time. We will notify you of significant changes to our Privacy Policy by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site. Significant changes will go into effect 30 days following such notification. Non-material changes or clarifications will take effect immediately. You should periodically check the Site and this privacy page for updates.
